The King’s Hawaiian Snowhana Photo Contest (“Contest”) is sponsored by King’s Hawaiian Bakery, West Inc., (“Sponsor”), 19161 Harborgate Way, Torrance, CA 90501.

1. CONTEST PERIOD: The Contest entry period starts on December 3, 2020 at 12:00 AM (midnight) Pacific Time and ends on December 17, 2020 at 11:59:59 PM Pacific Time (“Contest Period”).  
2. ELIGIBILITY: This Contest is offered to legal residents of the fifty (50) United States and the District of Columbia, who are at least eighteen (18) years of age or older at the time of entry. Employees, officers, directors, representatives, and agents of Sponsor and its parent, subsidiaries and affiliates, and each of their respective immediate family members and persons living in the same household of each, whether or not related, are not eligible to participate. Void in Puerto Rico, outside the U.S. and wherever restricted or prohibited by law. All applicable federal, state, and local laws and regulations apply.
3. HOW TO ENTER: During the Contest Period, create a snowman (“Snowhana”) using King’s Hawaiian Rolls and post a photo of your Snowhana creation on Instagram, Twitter or Facebook (each, a “Social Media Platform”). Each post must tag @kingshawaiian and use the hashtag #snowhana. The Social Media Platform account that you use to enter must be set to “public.” You can return your account to “private” at any time after the Contest Period. This Contest is in no way sponsored, endorsed or administered by Instagram, Twitter or Facebook.
4. PHOTO REQUIREMENTS: All photos must comply with the following guidelines:

• Photos must be the original work of the entrant and must not contain images or artwork, quotes or other content not created by entrant.
• Photos must not contain material that violates or infringes another's rights, including, but not limited to, privacy, publicity or intellectual property rights, including copyright infringement, or legal or moral rights of any third party, living or deceased.
• Photos cannot include a reference to brand names and/or images, except that you can include references to King’s Hawaiian products.
• Photos must not include any images of individuals or other personally identifiable information.
• Photos must not contain, reference, or use material that is fraudulent, indecent, lewd, profane, pornographic, obscene, tortious, defamatory or that promotes discrimination based on race, gender, ethnicity, religion, nationality, disability, sexual orientation, political orientation, citizenship, ancestry, marital status or age.

12. Selection of Winners: The 20 best posted photos will be selected by Sponsor’s marketing team. Photos will be judged based upon originality, technical quality, creativity, artistry, the extent to which a photo showcases King’s Hawaiian products, as well as overall appeal. Each winner will be contacted via the Social Media Platform on which their winning photo was posted within approximately one week after the end of the Contest Period. Sponsor’s decisions shall be final and binding in all matters pertaining to the judging and selection of winners.
13. License Grant to Sponsor: Each winner, by having posted a photo in the manner required by these Official Rules, grants to Sponsor a non-exclusive, worldwide, irrevocable license to Sponsor and any of its affiliates to display, reproduce, distribute, create derivative works of, and copy, any winning photo in any medium (including, without limitation, in print, digital, web, or social media) in connection with the Contest or in connection with Sponsor’s marketing efforts, including the promotion of Sponsor’s products and services. While Sponsor may provide photo credit in all uses of any winning photo, Sponsor is under no obligation to do so and each entrant waives any and all claims against Sponsor for the infringement of any intellectual property right, including moral rights, arising out of or in relation to any posted photo or Sponsor’s use of any posted photo.
14. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): A thirty dollar ($30.00) gift card will be awarded to each of 20 winners. The gift cards can only be used on Sponsor’s online store. The ARV of each gift card is $30.00. The total ARV of all gift cards is $600.00. The gift cards cannot be redeemed or exchanged for cash, except where required by law. In no event will more than 20 gift card prizes be awarded. No prize substitution or exchange will be allowed.
15. HOW TO CLAIM THE PRIZE: Within approximately one week after the end of the Contest Period, potential winners will be notified via the Social Media Platform on which the entrant has posted a photo. Each potential winner shall be subject to verification of eligibility and compliance with these Official Rules. Before being declared a verified winner, each potential winner may be required to confirm that he/she has read these Official Rules and agrees to the terms and conditions of these Official Rules. Upon verification of eligibility, each winner will be contacted regarding prize fulfillment. Sponsor shall not be held responsible for any delays in awarding any prize for any reason. If a potential winner is found to be ineligible, is not in compliance with these Official Rules, declines to accept a prize, or any winner notification is returned as undeliverable or the potential winner fails to respond to a winner notification within the timeframe specified in such winner notification, or if a potential winner does not answer the initial notification, the prize may be forfeited. Odds of winning any prize depend upon the number of eligible photos that are posted during the Contest Period.
16. DISPUTES: THESE OFFICIAL RULES ARE GOVERNED BY, AND SHALL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN THE COUNTY OF LOS ANGELES, CALIFORNIA. IF ANY CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JAMS IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN CALIFORNIA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF LOS ANGELES, CALIFORNIA. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM). ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR OF THE TIME THE CAUSE OF ACTION ACCRUED, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

18. PUBLICITY RIGHTS: By participating in this Contest, each Contest winner grants Sponsor and Sponsor’s designees the perpetual right to use his/her name, address (city and state), likeness, picture and other information provided in connection with the Contest for (i) inclusion in the Contest Winners List, and (ii) in connection with promoting and advertising each Contest winner’s winning photo for advertising and publicity purposes in all media worldwide including, but not limited to, on television and the Internet, without notice, review or approval and without additional compensation, except where prohibited by law.
19. WINNERS LIST: To obtain a list of the Contest winners, mail a self-addressed, stamped business-sized envelope to The King’s Hawaiian Snowhana Contest 19161 Harborgate Way, Torrance, CA 90501. Winners List requests must be received by January 31, 2021.
